Pro-actieve contactopname van de klanten per e-mail

Wanneer u via e-mail zakelijk met ons in contact treedt, verzamelen we uw persoonsgerelateerde gegevens (naam, e-mailadres, tekst van het bericht ) alleen in de door u ter beschikking gestelde omvang. De gegevensverwerking dient voor de bewerking en beantwoording van uw contactaanvraag.

Indien het opnemen van contact dient voor de uitvoering van precontractuele maatregelen (bijvoorbeeld advies in het geval van belangstelling voor een aankoop, het opstellen van offertes) of een reeds tussen u en ons gesloten overeenkomst betreft, gebeurt deze gegevensverwerking op grond van art. 6 lid 1 sub b DSGVO.

Gebeurt het opnemen van contact om andere redenen, gebeurt deze gegevensverwerking op grond van art. 6 lid 1 sub f DSGVO uit ons overwegende legitieme belang van de beantwoording van uw vraag. In dit geval hebt u het recht, op gronden, die voortvloeien uit uw specifieke situatie, op ieder moment bezwaar te maken tegen de op art. 6, lid 1, sub f DSGVO berustende verwerkingen van u betreffende persoonsgerelateerde gegevens.

Uw e-mailadres wordt alleen gebruikt om uw aanvraag te verwerken. Uw gegevens worden vervolgens onder in acht neming van wettelijke bewaringstermijnen gewist, indien u niet hebt ingestemd met verdere verwerking en gebruik.

Verzameling en verwerking bij gebruik van het contactformulier

Bij gebruik van het contactformulier, verzamelen we uw persoonsgegevens (naam, e-mailadres, berichttekst) alleen voor zover u deze hebt verstrekt. De gegevensverwerking dient voor het opnemen van contact.
Indien het opnemen van contact dient voor de uitvoering van precontractuele maatregelen (bijvoorbeeld advies in het geval van belangstelling voor een aankoop, het opstellen van offertes) of een reeds tussen u en ons gesloten overeenkomst betreft, gebeurt deze gegevensverwerking op grond van art. 6 lid 1 sub b DSGVO.

Klantaccount Bestellingen

Klantaccount

Bij de opening van een klantaccount verzamelen wij uw persoonsgegevens in de daarbij aangegeven omvang. Het doel van gegevensverwerking is om uw aankoopervaring te verbeteren en orderverwerking te vereenvoudigen. De verwerking vindt met uw toestemming plaats op basis van artikel 6 (1) sub a AVG. U kunt uw toestemming te allen tijde intrekken door ons hiervan op de hoogte te stellen zonder dat dit van invloed is op de rechtmatigheid van de verwerking die op basis van de toestemming is uitgevoerd tot aan de intrekking. Uw klantaccount wordt vervolgens gewist.

Verzameling, verwerking en doorgifte van persoonsgegevens bij bestellingen

Wij verzamelen en verwerken uw persoonsgegevens alleen in de mate die nodig is voor de uitvoering en verwerking van uw bestelling en voor de verwerking van uw verzoeken. De beschikbaarstelling van de gegevens is noodzakelijk voor het sluiten van de overeenkomst. Het niet beschikbaar stellen heeft tot gevolg dat er geen overeenkomst kan worden gesloten. De verwerking gebeurt op basis van art. 6, par. 1 sub b AVG en is noodzakelijk voor de totstandkoming van een overeenkomst met u.

Uw gegevens worden bijvoorbeeld gedeeld met verzendbedrijven, dropshipping- of fulfilment-aanbieders, betalingsdienstverleners, dienstverleners voor orderverwerking en IT-dienstverleners. In alle gevallen houden wij ons strikt aan de wettelijke voorschriften. De omvang van de gegevensoverdracht blijft tot een minimum beperkt.

Gebruik van PayPal
Op onze website maken wij gebruik van de betalingsservice PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxemburg; "PayPal"). Het doel van de verwerking van gegevens is om u betalingen via de betalingsdienst aan te bieden. Wanneer u PayPal selecteert en gebruikt om te betalen, worden de gegevens die nodig zijn om de betaling te verwerken aan PayPal doorgegeven, zodat wij de overeenkomst die wij met u hebben, kunnen nakomen via de door u geselecteerde betalingsmethode. Het doel van de verwerking van gegevens is om u betalingen via de betalingsdienst aan te bieden. Als u betalingen via PayPal, creditcard via PayPal, automatische incasso via PayPal selecteert en gebruikt, worden de gegevens die nodig zijn voor de verwerking van de betaling aan PayPal doorgegeven om het contract met u met de gekozen betaalmethode uit te voeren. Deze verwerking is gebaseerd op artikel 6, lid 1, onder b), van de GDPR.

In het geval van individuele betalingsmethoden, zoals creditcard via PayPal, automatische incasso via PayPal, behoudt PayPal zich het recht voor om, indien nodig, een kredietrapport op te vragen op basis van wiskundig-statistische procedures met behulp van kredietreferentiebureaus. Daartoe geeft PayPal de voor de kredietcontrole benodigde persoonsgegevens door aan het kredietbureau en gebruikt de verkregen informatie over de statistische kans op wanbetaling om een weloverwogen beslissing te nemen over de totstandkoming, uitvoering of beëindiging van de contractuele relatie. De kredietwaardigheidsinformatie kan waarschijnlijkheidswaarden (scorewaarden) bevatten, die worden berekend op basis van wetenschappelijk erkende mathematisch-statistische procedures en waarbij onder meer rekening wordt gehouden met adresgegevens. Met uw legitieme belangen zal overeenkomstig de wet rekening worden gehouden. Het doel van de gegevensverwerking is kredietbeoordeling met het oog op het aangaan van een contract. De verwerking wordt uitgevoerd op basis van artikel 6, lid 1, onder f), van de GDPR, op basis van ons hoger legitiem belang om te beschermen tegen insolventie wanneer PayPal voorschotten betaalt.
U hebt het recht om te allen tijde bezwaar te maken tegen de verwerking van uw persoonsgegevens op basis van artikel 6, lid 1, onder f), van de GDPR als dit is gebaseerd op uw bijzondere situatie door PayPal hiervan op de hoogte te stellen. Het verstrekken van de gegevens is noodzakelijk voor het sluiten van het contract met de door u gekozen betaalmethode. Als u deze gegevens niet verstrekt, wordt er geen contract gesloten met de door u gekozen betaalmethode.

Gebruik van PayPal Express

Wij gebruiken op onze website de betaaldienst PayPal Express van PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxemburg; "PayPal").

De gegevensverwerking heeft tot doel u de mogelijkheid te bieden om via de betaalservice van PayPal Express te betalen.

Voor de integratie van deze betalingsdienst is het noodzakelijk, dat PayPal bij het openen van de website gegevens (bijvoorbeeld IP-adres, apparaattype, besturingssysteem, browsertype, locatie van uw apparaat) verzamelt, opslaat en analyseert. Hiervoor kunnen ook cookies worden ingezet. De cookies maken het mogelijk uw browser (weer) te herkennen.

Het gebruik van cookies of vergelijkbare technologieën gebeurt op grond van § 15 lid 3 S. 1 TMG. De verwerking van uw persoonsgerelateerde gegevens gebeurt op grond van art. 6 lid 1 punt f van de AVG vanuit ons overwegend legitieme belang van een klantgericht aanbod van verschillende betalingsmogelijkheden. U hebt het recht om op gronden die voortvloeien uit uw specifieke situatie, op ieder moment bezwaar te maken tegen deze verwerkingen van de u betreffende persoonsgerelateerde gegevens.

Door PayPal Express te selecteren en te gebruiken, worden de gegevens die nodig zijn voor de betalingsverwerking overgedragen aan PayPal om de overeenkomst met u met de gekozen betaalmethode te kunnen uitvoeren. Deze verwerking gebeurt op basis van art. 6, lid 1, punt b van de AVG.

Gebruik van PayPal Check-Out
Wij gebruiken de PayPal Check-Out betalingsservice van PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxemburg; "PayPal") op onze website. De gegevensverwerking dient om u de betaling via de betalingsdienst te kunnen aanbieden. Bij de keuze en het gebruik van betaling via PayPal, creditcard via PayPal, automatische incasso via PayPal of "Betaal later" via PayPal worden de voor de betalingsverwerking vereiste gegevens aan PayPal doorgegeven om de overeenkomst met u met de gekozen betalingsmethode te kunnen nakomen. Deze verwerking is gebaseerd op Art. 6 Para. 1 lit. b DSGVO.

Hierbij kunnen cookies worden opgeslagen, die een herkenning van uw browser mogelijk maken. De desbetreffende gegevensverwerking vindt plaats op basis van art. 6, lid 1, sub f AVG vanuit ons overwegend legitieme belang van een klantgericht aanbod van verschillende betalingsmogelijkheden. U hebt het recht om op gronden die voortvloeien uit uw specifieke situatie, op ieder moment bezwaar te maken tegen deze verwerking van uw persoonsgegevens.

Kredietkaart via PayPal, automatische incasso via PayPal & "Betaal later" via PayPal
Voor individuele betaalmethoden zoals creditcard via PayPal, automatische incasso via PayPal of "Later betalen" via PayPal behoudt PayPal zich het recht voor om kredietinformatie te verkrijgen op basis van mathematisch-statistische methoden met behulp van kredietbureaus. Hiertoe geeft PayPal de voor een kredietcontrole vereiste persoonsgegevens door aan een kredietagentschap en gebruikt de ontvangen informatie over de statistische waarschijnlijkheid van een betalingsachterstand voor een afgewogen beslissing over de totstandkoming, uitvoering of beëindiging van de contractuele relatie. De kredietwaardigheidsinformatie kan waarschijnlijkheidswaarden (scorewaarden) omvatten die worden berekend op basis van wetenschappelijk erkende mathematisch-statistische procedures en bij de berekening waarvan onder meer adresgegevens worden betrokken. Met uw beschermingswaardige belangen wordt rekening gehouden overeenkomstig de wettelijke bepalingen. De gegevensverwerking dient ter beoordeling van de kredietwaardigheid voor het aangaan van een contract. De verwerking wordt uitgevoerd op basis van Art. 6 Para. 1 lit. f DSGVO voor ons doorslaggevend legitiem belang in bescherming tegen betalingsverzuim wanneer PayPal voorschotten betaalt.
U hebt het recht om te allen tijde bezwaar te maken tegen deze verwerking van uw persoonsgegevens op basis van art. 6 (1) (f) DSGVO om redenen die voortvloeien uit uw bijzondere situatie door PayPal hiervan op de hoogte te stellen. De verstrekking van de gegevens is noodzakelijk voor de sluiting van het contract met de door u gevraagde betalingsmethode. Het niet verstrekken van de gegevens heeft tot gevolg dat het contract met de door u gekozen betalingswijze niet kan worden gesloten.

Lokale derde dienstverleners
Bij betaling via de betaalmethode van een lokale derde aanbieder worden de voor de verwerking van de betaling vereiste gegevens doorgegeven aan PayPal. Deze verwerking vindt plaats op grond van artikel 6, lid 1, onder b), van de AVG. Om dit soort betalingen uit te voeren, kunnen de gegevens vervolgens door PayPal worden doorgegeven aan de desbetreffende aanbieder. Deze verwerking is gebaseerd op Art. 6 Para. 1 lit. b DSGVO. Lokale derde-partij aanbieders kunnen, bijvoorbeeld:

Aankoop op rekening via PayPal
Bij betaling via de betaalmethode aankoop op rekening worden de gegevens die nodig zijn om de betaling te verwerken, eerst naar PayPal gestuurd. Voor de uitvoering van deze betaalmethode worden de gegevens vervolgens door PayPal doorgegeven aan Ratepay GmbH (Franklinstraße 28-29, 10587 Berlijn; "Ratepay") om de overeenkomst met u met de gekozen betaalmethode te kunnen uitvoeren. Deze verwerking is gebaseerd op Art. 6 Para. 1 lit. b DSGVO. Indien nodig voert Ratepay een kredietcontrole uit op basis van mathematisch-statistische procedures met behulp van kredietagentschappen volgens de hierboven reeds beschreven procedure. De gegevensverwerking dient ter beoordeling van de kredietwaardigheid voor het aangaan van een contract. De verwerking wordt uitgevoerd op basis van art. 6 (1) lit. f DSGVO vanwege ons doorslaggevend legitiem belang bij de bescherming tegen wanbetaling wanneer Ratepay voorschotten betaalt. Analyse

Gebruik van Google Analytics 4

Wij maken op onze website gebruik van de webanalysedienst Google Analytics die wordt aangeboden door Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ierland; "Google").

De gegevensverwerking dient voor de analyse van deze website en zijn bezoekers, alsmede voor marketing- en reclamedoeleinden. In opdracht van de exploitant van deze website zal Google de verkregen informatie gebruiken om uw gebruik van de website te analyseren, om rapporten over de websiteactiviteiten samen te stellen en om de exploitant van de website andere diensten in verband met het website- en internetgebruik aan te bieden.

Daarbij kan onder meer de volgende informatie worden verzameld: IP-adres, datum en tijd van paginaweergave, klikpad, informatie over de browser die u gebruikt en het apparaat dat u gebruikt (apparaat), bezochte pagina's, referrer URL (website van waaruit u op onze website bent gekomen), locatiegegevens, aankoopactiviteiten. Google gebruikt technologieën zoals cookies, webopslag in de browser en trackingpixels, die een analyse van uw gebruik van de website mogelijk maken. Het gebruik van cookies of vergelijkbare technologieën vindt plaats met uw toestemming op basis van § 25 par. 1 p. 1 TDDDG in combinatie met. Art. 6 lid 1 lit. a DSGVO.

De verwerking van uw persoonsgegevens gebeurt met uw toestemming op basis van Art. 6 para. 1 lit. a DSGVO. U kunt uw toestemming te allen tijde intrekken zonder dat dit gevolgen heeft voor de rechtmatigheid van de verwerking die op basis van de toestemming tot aan de intrekking heeft plaatsgevonden.

De hierdoor gegenereerde informatie over uw gebruik van deze website wordt gewoonlijk overgebracht naar een server van Google in de VS en daar opgeslagen. Plug-ins

Gebruik van Social Plug-ins
Wij gebruiken op onze website plug-ins van sociale netwerken. De integratie van social plug-ins het en de daarbij plaatsvindende gegevensverwerking dient voor de optimalisatie van de reclame voor onze producten.
Bij de integratie van social plug-ins wordt een koppeling tussen uw computer en de servers van de aanbieder van het sociale netwerk tot stand gebracht en daarbij de plug-in door mededeling aan uw browser op de pagina weergegeven, mits u uitdrukkelijk heeft toegestemd. Hierbij worden zowel uw IP-adres alsook de informatie, welke van onze pagina's u heeft bezocht, aan de server van de aanbieder overgedragen. Dit geldt ongeacht of u bij het sociale netwerk bent geregistreerd of ingelogd. Zelfs bij niet-geregistreerde of niet-ingelogde gebruikers vindt een overdracht plaats. Het gebruik van cookies of vergelijkbare technologieën gebeurt met uw toestemming op grond van § 25 lid 1 S. 1 TDDDG i.c.m. art. 6 lid 1 sub a AVG. De verwerking van uw persoonsgerelateerde gegevens gebeurt met uw toestemming op grond van art. 6 lid 1 sub a AVG. U kunt de toestemming altijd intrekken zonder dat dit van invloed is op de rechtmatigheid van de verwerking die op basis van de toestemming is uitgevoerd tot aan de intrekking.

Meta Platforms Ireland is ervoor verantwoordelijk de rechten van betrokkenen conform art. 15 - 20 AVG mogelijk te maken, de veiligheidsbepalingen van art 32 AVG met het oog op de veiligheid van de dienst aan te houden en de verplichtingen conform art. 33, 34 AVG, voor zover een schending van de bescherming van persoonsgerelateerde gegevens de verplichtingen van Meta Platforms Ireland conform de overeenkomst over de gezamenlijke verwerking betreft.

Gebruik van sociale plug-ins via de “tweekliksoplossing“

We gebruiken plug-ins van sociale netwerken op onze website met behulp van de "tweekliksoplossing". Daarbij worden zonder uw uitdrukkelijke toestemming geen verbindingen gemaakt met de servers van de sociale netwerken en bijgevolg geen gegevens overgedragen.

Bij de standaardintegratie van plug-ins wordt bij de toegang tot de internetpagina's van onze website die een dergelijke plug-in bevatten, een verbinding tussen uw computer en de servers van de sociale netwerkproviders tot stand gebracht en wordt de plug-in op de internetpagina weergegeven door uw browser hiervan op de hoogte te stellen. Hierbij worden zowel uw IP-adres alsook de informatie die u op onze internetpagina's hebt bezocht, aan de server van de provider doorgegeven. Dit geldt ongeacht of u bij het sociale netwerk bent geregistreerd of ingelogd. Zelfs bij niet-geregistreerde of niet-ingelogde gebruikers vindt een overdracht plaats. Als u ook bent ingelogd op het Social Network Facebook, wordt deze informatie toegewezen aan uw persoonlijke gebruikersaccount. Bij gebruik van de plug-in-functies (bijv. door het indrukken van de button) wordt ook deze informatie aan uw gebruikersaccount toegewezen, wat u alleen door uitloggen vóór het gebruik van de plug-in kunt verhinderen. Om de controle over uw gegevens te behouden, hebben wij besloten om in eerste instantie de betreffende button te deactiveren. U herkent dit aan de grijze knop. Zonder uw uitdrukkelijke toestemming - in de vorm van het activeren van de knop - wordt er geen verbinding met de sociale netwerkserver tot stand gebracht en worden er bijgevolg ook geen gegevens overgedragen.

Pas wanneer u de knop activeert, wordt de button actief (gekleurd gemarkeerd) en wordt een directe verbinding met de servers van het sociale netwerk opgebouwd.

Door het activeren geeft u toestemming voor de overdracht van uw gegevens aan de betreffende provider van het sociale netwerk. Hierbij worden o.a. zowel uw IP-adres alsook de informatie die u op onze internetpagina's hebt bezocht, doorgegeven. Wanneer u tegelijkertijd met één of meer van uw sociale netwerkaccounts verbonden bent, wordt de verzamelde informatie ook toegewezen aan uw respectievelijke profielen. U kunt deze toewijzing alleen voorkomen door uit te loggen van uw gebruikersaccounts op de sociale netwerken voordat u onze website bezoekt en voordat u de knoppen activeert.

Gebruik van YouTube
Wij gebruiken op onze website de functie voor inbedding van YouTube-video's van Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ierland; „YouTube“).YouTube Is een met Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, VS; “Google”) verbonden onderneming.
De functie geeft video's weer die zijn gedeponeerd bij YouTube in een iFrame op de website. Daarbij is de optie „Geavanceerde privacymodus“ geactiveerd. Daardoor slaat YouTube geen informatie op over de bezoekers van de website. Pas wanneer u een video bekijkt, wordt de informatie hierover aan YouTube doorgegeven en daar opgeslagen. Indien nodig worden uw gegevens naar de VS verzonden. Voor de VS is een adequaatheidsbesluit van de EU-commissie aanwezig: het Trans-Atlantic Data Privacy Framework (TADPF). Gebruik van Vimeo
Wij gebruiken op onze website plug-ins van Vimeo Inc. (555 West 18th Street New York, New York 10011, VS; "Vimeo") voor de integratie van video's van het "Vimeo"-portaal.
Wanneer u met zo'n plug-in bepaalde pagina's van onze website oproept, wordt een verbinding met de Vimeo-servers gemaakt en daarbij de plug-in door middel van een bericht aan uw browser op de pagina weergegeven. Hierdoor wordt zowel uw IP-adres als ook de informatie, welke van onze pagina's u bezocht heeft, aan de servers van Vimeo overgedragen.
Als u bent ingelogd bij Vimeo, zal Vimeo deze informatie toewijzen aan uw persoonlijk gebruikersaccount. Bij gebruik van de plug-in-functies (bijv. door het starten van een video door het indrukken van de betreffende knop) wordt ook deze informatie bij uw Vimeo-account geplaatst.

Integratie van het Händlerbund-ledenlogo
Het Händlerbund-ledenlogo (Händlerbund e.V., Kohlgartenstraße 11 - 13, 04315 Leipzig) is op onze website geïntegreerd. Wanneer u onze website bezoekt, stuurt de browser van uw apparaat automatisch informatie naar de server van de Händlerbund e.V.. Deze informatie wordt tijdelijk gedurende 7 dagen in een zogenaamd serverlogbestand opgeslagen. De volgende informatie wordt zonder enige actie van uw kant geregistreerd en opgeslagen totdat ze automatisch wordt gewist:

IP-adres van de aanvragende computer,
Datum en tijd van toegang,
Naam en URL van het opgehaalde bestand,
de website vanwaar toegang is verkregen (referrer URL),
gebruikte browser en, indien van toepassing, het besturingssysteem van uw computer en de naam van uw toegangsprovider.

Tijdelijke opslag van het IP-adres door het systeem is nodig om levering van de website mogelijk te maken. Hiervoor moet het IP-adres voor de duur van de sessie opgeslagen blijven. De gegevens worden opgeslagen in logbestanden om de functionaliteit van de website te garanderen. De gegevens worden ook gebruikt om de website te optimaliseren en de veiligheid van de informatietechnologiesystemen te garanderen. Deze gegevens worden niet samen met andere persoonsgegevens opgeslagen. De rechtsgrondslag voor gegevensverwerking is art. 6 lid 1 zin 1 lit. f GDPR.

Integratie van het logo van het “FairCommerce”-initiatief
Het logo van het initiatief “FairCommerce” (Händlerbund e.V., Kohlgartenstraße 11 - 13, 04315 Leipzig) is op onze website geïntegreerd. Wanneer u onze website bezoekt, stuurt de browser van uw apparaat automatisch informatie naar de server van Händlerbund e.V.. Deze informatie wordt tijdelijk gedurende 7 dagen in een zogenaamd serverlogbestand opgeslagen. De volgende informatie wordt zonder enige actie van uw kant geregistreerd en opgeslagen totdat ze automatisch wordt gewist:

IP-adres van de aanvragende computer,
Datum en tijd van toegang,
Naam en URL van het opgehaalde bestand,
de website vanwaar toegang is verkregen (referrer URL),
gebruikte browser en, indien van toepassing, het besturingssysteem van uw computer en de naam van uw toegangsprovider.

Duur van de opslag

Na afloop van de overeenkomst worden de gegevens eerst opgeslagen voor de duur van de garantieperiode, vervolgens met inachtneming van de wettelijke bewaartermijnen, in het bijzonder de fiscaal- en handelsrechtelijke, en na afloop van deze periode gewist, voor zover u niet akkoord bent gegaan met verdere verwerking en gebruik.

Rechten van de getroffen persoon

Als aan de wettelijke vereisten is voldaan heeft u overeenkomstig de artikelen 15 tot en met 20 van de AVG de volgende rechten: Recht op informatie, correctie, verwijdering, beperking van de verwerking, overdraagbaarheid van gegevens.

Bovendien heeft u op grond van artikel 21 (1) AVG het recht bezwaar aan te tekenen tegen de verwerking op basis van artikel 6 (1) f AVG, evenals tegen de verwerking gericht op direct mail.

Recht om klacht in te dienen bij een toezichthoudende autoriteit

Overeenkomstig artikel 77 AVG heeft u het recht een klacht in te dienen bij de toezichthouder als u van mening bent dat de verwerking van uw persoonsgegevens niet rechtmatig gebeurt.

U kunt een klacht indienen bij de voor ons verantwoordelijke toezichthoudende autoriteit, die u kunt bereiken onder de volgende contactgegevens:

Recht om bezwaar te maken

Indien de hier vermelde verwerking van persoonsgegevens is gebaseerd op onze gerechtvaardigde belangen conform art. 6, par. 1 sub f AVG, heeft u het recht, om redenen die voortvloeien uit uw specifieke situatie, om te allen tijde tegen deze verwerkingen met toekomstige gevolgen bezwaar te maken.

Na succesvol bezwaar wordt de verwerking van de betreffende gegevens beëindigd, tenzij wij kunnen aantonen dat er sprake is van een dwingende verdedigbare reden voor de verwerking en die zwaarder weegt dan uw belangen, rechten en vrijheden, of indien de verwerking strekt tot indiening, uitoefening of verdediging van rechtsvorderingen.
